Terms & Conditions

Welcome to Digital Asset Co. By purchasing, downloading, or using any products from digitalassetco.com.au (“the Site”), you agree to the following Terms & Conditions. Please read them carefully before completing any purchase.

1. GENERAL INFORMATION

These Terms & Conditions govern your use of all digital products, stock photos, video assets, templates, and resources provided by Digital Asset Co (“we”, “us”, “our”). All products sold are digital goods. No physical items are shipped.

2. LICENSING TERMS

2.1 Personal License

You can use the assets for:

  • Personal social media posts (Instagram, TikTok, Pinterest, etc.)

  • Personal mood boards, inspiration boards, or presentations

  • Desktop backgrounds, wallpapers

  • Personal blog posts with no monetization

  • Personal creative projects (vision boards, personal branding practice, etc.)

You can not use the assets for:

  • Anything that results in monetary gain

  • Advertising or promotional materials for a business

  • Selling, redistributing, or sharing the files

  • Using the images in client projects

2.2 Commercial License

You can use the assets for:

  • Business social media content

  • Promotional graphics, branding content, ads (organic + paid)

  • Website and blog content

  • Marketing materials (flyers, lookbooks, newsletters, product pages)

  • Client presentations and project showcases

  • Digital products where the image is not the main value (e.g., ebook covers, templates where the image is locked and non-extractable)

You can not use the assets for:

  • Reselling or redistributing the image in any form

  • Using the image as the primary product (e.g., downloadable wallpapers, prints)

  • Including the asset in editable templates or files where the image can be extracted

  • Using the asset for mass production (over 5,000 units)

  • Using the asset for TV, streaming, film, or broadcast

2.3 Extended Commercial License

You can use the assets for:

  • All Commercial Use permissions

  • Unlimited client projects

  • Mass production & manufacturing

    • Apparel

    • Packaging

    • Books, prints, posters

    • Products for sale (up to 250,000 total units)

  • Use in paid advertising campaigns without spend caps

  • Use in apps, software, or digital products where the file is not extractable

You can not use the assets for:

  • Selling or licensing the images as standalone assets

  • Using the image in AI datasets or training models

  • Trademarking the image or claiming exclusive rights

  • Using the asset in TV/film with distribution over 500,000 (requires custom license)

2.4 Non-Exclusive License

All licences are non-exclusive, meaning other customers may purchase and use the same assets.

3. PROHIBITED USES (ALL LICENSES)

You may not:

  • Resell, share, gift, or redistribute the assets in any form

  • Claim the assets as your own or imply you created them

  • Use the assets in obscene, defamatory, hateful, or harmful content

  • Use the assets in AI training datasets, models, or generators

  • Mint NFTs or blockchain-based products

  • Use the assets in logo trademarks

  • Use the files in any way that competes with Digital Asset Co

  • Upload the assets to any stock site or marketplace as your own

Failure to comply will result in licence termination without refund and link access revoked.

4. DIGITAL DOWNLOAD TERMS

All products are delivered digitally and become available immediately after purchase.

By purchasing, you acknowledge:

  • You are responsible for saving and backing up your files

  • You understand no physical product will be shipped

  • You agree that download links must not be shared or forwarded

  • Lost files can only be resent at our discretion

  • Digital Asset Co is not responsible for incomplete downloads caused by device or internet issues

5. REFUND POLICY

Due to the nature of digital products all sales are final. No refunds, returns, or exchanges.

Refunds are only provided if:

  • A duplicate order was accidentally placed

  • A technical issue on our side prevented you from accessing the product

If you believe you qualify for a refund, please contact us at hello@digitalassetco.com.au within 7 days of your purchase.

6. PRICING & PAYMENT

All prices are listed in AUD unless otherwise stated.
We reserve the right to adjust pricing, run promotions, or modify product availability at any time.

Payment is processed securely via third-party providers (e.g., Stripe, PayPal).

Digital Asset Co does not store your credit card information.

7. INTELLECTUAL PROPERTY RIGHTS

All content on this Site—including images, videos, graphics, digital files, branding, copy, and design elements—is the sole property of Digital Asset Co.

You acknowledge that:

  • Purchasing a product does not transfer copyright

  • You receive a licence to use the asset, not ownership

  • You may not claim any Digital Asset Co product as your own creation

Copyright remains with Digital Asset Co at all times.

8. LIMITATION OF LIABILITY

Digital Asset Co is not liable for:

  • Loss of profits

  • Business interruption

  • Loss of data

  • Inappropriate or unlawful usage of assets by the customer

  • Any indirect or consequential damages arising from product use

All products are provided “as is” without warranties of any kind.

9. TERMINATION OF LICENCE

We reserve the right to revoke a licence if:

  • You breach any terms outlined here

  • You misuse the product

  • You engage in redistribution, resale, or prohibited use

Upon termination, you must immediately stop using the asset and delete all copies.

10. MODIFICATIONS TO TERMS

We may update or modify these Terms & Conditions at any time. Continued use of our products constitutes acceptance of the updated terms.
